Candidate List of Substances for Eventual Inclusion in Authorisation process

On Aug 31st, 2009, ECHA published, on its website, proposals to identify 15 new substances of very high concern (SVHC) which have been submitted by Member States and the Commission for inclusion onto the Candidate List of Substances of Very High Concern for Authorisation. The publication on the ECHA website marks the start of the 45 day consultation period during which interested parties have an opportunity to comment on the substances. Following the 45 days there are various procedures which need to be completed within ECHA before the updated Candidate List is published.  We expect that this process will be complete by end 2009 or the beginning of 2010. 

Once the process has completed and the updated Candidate List has been published, ExxonMobil will update any documents and communications with our customers and users of our products if appropriate.

 

 

On October 28, 2008, the first Candidate list of substances for eventual inclusion on the Annex XIV List of Substances subject to Authorisation (Candidate list) was published by the European Chemicals Agency (ECHA) on its website.

Following this publication, the requirements of Article 31.1.c and Article 33 come into effect.

 Article 31.1.c requires that the supplier of a substance or a preparation shall provide the recipient of the substance or preparation with a safety data sheet where a substance  as such or as part of the preparation is included in the Candidate list.

According to our records, no ExxonMobil manufactured products except those listed in the attachment(s) contain a Candidate List substance at > 0.1wt%. Similarly, ExxonMobil has received no notification from our suppliers indicating the presence of a Candidate list substance in the products which we purchase.

Article 33.1 requires that any supplier of an article containing > 0.1 wt % of a substance on the Candidate list shall provide the recipient of the article with sufficient information, available to the supplier, to allow safe use of the article including, as a minimum, the name of that substance.

To date, ExxonMobil has received no such information from our suppliers of articles.

Article 33.2 requires that, on request by a consumer, any supplier of an article containing > 0.1 wt & of a substance on the preliminary list of priority substances for inclusion on the Annex XIV List of Substances subject to Authorisation shall provide the consumer with sufficient information, available to the supplier, to allow safe use of the article including, as a minimum, the name of that substance.

Based upon the above and the information currently available, we have no evidence that any products or articles supplied by ExxonMobil within the EU contain any of the substances referenced in the preliminary list of priority substances for inclusion on the Annex XIV List of Substances subject to Authorisation at > 0.1 wt % with the exception of the product(s) listed in the attachment(s).
